清代民国时期昆明契约文书中的规范与秩序

摘　　要：中国传统社会中,以契约文书记录社会活动的习惯由来已久。清代民国时期,昆明地区有大量记录当时民间社会法律活动的契约文书,这些契约文书的一部分被官方或民间收藏而留存至今。在梳理分析这些"宗族契约文书"和"社会关系契约文书"的基础上,探析清代民国时期昆明民间婚丧嫁娶、分家析产等家族活动以及手工业界学徒投师学艺过程中人们所遵循的各类规范的构成和内容,可以再现当时昆明民间社会在国家法、民间法等多元规范作用下呈现出的真实秩序图景。In traditional Chinese society,drafting and signing compacts was a time-honored practice.Many compacts and contracts of Kunming in the Qing dynasty and the Republic of China period are kept in government and nongovernment collections.Through careful cataloguing and analyzing these ' Family' and ' Social' compacts,this study hopes to re-create a faithful picture of the social norms and social order in Kunming of that age as governed by state and folk laws concerning marriage,funeral,household assets division,and apprentice customs and procedures in handicraft industry.
