论实现新发展理念的经济法改革——以加强劳动力权的保护为视角

摘　　要：实现创新、协调、绿色、开放、共享的新发展理念,需要完善的法治尤其是经济法的保障。当前,我国经济发展中出现了一些问题,表明现行具有经济行政法色彩的经济法存在不足,需要在新发展理念引领下进行改革。经济法改革应在"去经济行政法化"的同时,围绕加强对"劳动力权"的保护展开。经济法应当遵循创新发展理念、协调发展理念、绿色发展理念、开放发展理念、共享发展理念,为实现市场经济的创新、协调、绿色、开放、共享作出经济法治贡献。经济法改革应当尽快出台基本经济法,并将贯彻新发展理念的劳动力权保护写入基本经济法。除此之外,经济法各种具体法律制度的改革,主要包括:应当建立和完善人力资源能力建设法律制度,并在知识产权、人力资本入股等法律制度中,加强对劳动力权益的保护,以利于为创新发展服务;应当参与建立和完善宏观调控法律制度,以利于为协调发展服务;应当通过建立激励制度来完善循环经济法等,以利于为绿色发展服务;应当完善涉外竞争法律制度,以适应开放发展的需要;应当完善按劳分配法律制度、税负法律制度、国有资产经营权法律制度、竞争法律制度和消费者权益保护法律制度等,以利于为共享发展服务。To realize the new concept of development,including innovation,coordination,green,open and sharing,we need to perfect the rule of law,especially the protection of economic law. At the same time,there are some problems in the development of China's economy,which indicates that the current economic law with the color of economic administrative law has shortcomings and needs to be reformed under the guidance of the new concept of development. The reform of economic law should focus on strengthening the protection of 'labor rights'at the same time of'rejecting becoming economic administrative law'. The economic law should follow the concept of innovative development,coordinated development,green development,open development,sharing development,and contribute to the realization of innovation,coordination,green,open,sharing of the market economy. To reform the economic law,the basic economic law should be promulgated as soon as possible,and the protection of the labor right carrying out the new concept of development should be written into the basic economic law. In addition,the reform of economic law system mainly includes: establish and perfect the human resources construction legal system,and strengthen the protection of labor rights interests in the legal system of intellectual property rights,buying shares with human capital,etc,to facilitate the innovative development; establish and improve the legal system of macroeconomic control,to facilitate the coordinated development; establish an incentive system to improve the circulated economic law,to facilitate the green development; perfect the legal system of competition concerning foreign nationals,in order to meet the needs of the open development; perfect the law system of the distribution according to work,tax law system,state-owned assets management rights legal system,competition legal system and the legal system of protection of the consumer rights and interests,to facilitate the sharing development.
