摘 要:业主集资借用开发商资质自主建房,容易出现名义物权人与实际物权人的分离与权属争议。本文从现行法律规定和法理两方面进行分析后认为,借用开发商资质自主建房的物权应归属于业主所有而不是开发商,当一般债权人与自建房业主发生物权归属争议时,应平衡各方利益,对建房业主事实上的所有权予以保护。The owners raising independent housing developers borrow qualification,prone to separation and ownership dispute with the actual name of property right person.This article analyzes the two aspects of the current legal provisions and legal theory,the real estate fights of the developers should be attributed to the owners,not the developers,when the general creditor and the owner of the self built house have the conflict of interest in the ownership of the biological property, the interests of all parties should be balanced to protect the factual ownership of the building owner.
