体育赛事定价中的主体商谈与权利实现

摘　　要：体育赛事定价问题的出现既表现出我国体育市场化的不成熟,又表现出我国体育市场法治建设的滞后。体育赛事定价的盈利性、独断性、肆意性超越了其应有的社会性、参与性和合法性,造成关联主体价格权利的保护失位,最终影响体育赛事经营者和体育赛事本身的可持续发展。在经济民主和商谈民主的语境下,体育赛事定价应当从话语、场域和规则的建设出发,落脚于主体权利的实现,在"权利-义务-责任"的框架内寻求体育赛事价格活动的有序开展。经营者、消费者和政府在体育赛事定价商谈中扮演了不同的角色,而消费者权利应当成为定价商谈的重中之重。通过公共领域代表制度和听证制度,可以尝试进行制度拟制,促进体育赛事定价领域的商谈民主形成。The pricing problems of sports events show that China＇s sports market is not mature,and that the construction of the rule of law of China＇s sports market lags behind.The profitability,arbitrariness,uncheckedness of sports event pricing violates its due sociality,participation and legitimacy,resulting in the loss of the related subject rights protection,which will in turn influence the sustainable development of sports event and the operators.In the context of economic democracy and deliberative democracy,the pricing of sports events should be based on the construction of discourse,field and rules,take hold in the realization of the subject right and seek sports event pricing activities carried out in an orderly manner within the framework of the ＂right-obligation-duty＂.Operators,consumers and the government have played different roles in the price negotiation of sports events,and consumers＇ rights should be the most important part of pricing negotiations.Through the representative system and the hearing system in the public sphere,we can try to make the system to be made,and promote the formation of deliberative democracy in the field of sports event pricing.
