自治立法权的行使现状及对策研究——以广西12个自治县自治条例为分析视角

摘　　要：由于自治条例和《民族区域自治法》实施办法的阙如,广西在自治区一级自治立法权行使方面极为有限。从自治县自治立法现状来看,各自治县均已制定自治条例,但存在重复上位法条款或结构、超越立法权限、规定模糊或缺乏可操作性、缺少法律责任条款、未能较好彰显民族特性、立法质量不高、公众参与不足等问题。为有效落实《民族区域自治法》,需要以优惠照顾理论修复中央与自治地方关系,尽快制定自治区自治条例和实施办法。在立法过程中,要构建自治立法评估机制,科学规划自治立法,创设民族立法专家库,扩大公众参与渠道和力度,并建立健全自治条例实施的监督保障机制。Due to the absence of autonomous regulations and ＂Law on Regional Ethnic Autonomy＂, the exercise of regional level Guangxi is extremely limited. Seeing from the legislative situation of the fact that the whole autonomous counties have already formulated implementation autonomous 1 measures of the egislative right in the autonomous county, despite regulations, a number of problems still exist, i.e. terms or structure of the upper law are repeated, some provisions are beyond the legislative authority, vague in content or lack of operability, legal liability provisions are ab- sent, poor reflection of ethnic characteristics, low quality of legislation, insufficient public partici- pation etc.. For the effective implementation of ＂Law on Regional Ethnic Autonomy＂, it is necessary to repair the relationship between central government and autonomous region according to the preferential theory, and autonomous regulations and implementation measures ought to be enacted as soon as possible. In the legislative process, we should set up an evaluation mechanism for autonomous legislation, and plan autonomous legislation scientifically. In addition, we should set up a thinktank of experts specialized in ethnic legislation, expand the channels and efforts for public participation, and establish and improve the supervision and protection mechanism for the implementation of autonomous regulations.
