摘　　要：《法律解释学》是张志铭教授的代表作,其吸收了哲学解释学和语言哲学的最新智识资源,并借鉴西方法律解释实践的经验智慧,对法律解释学进行了知识体系的建构。从认识论的视角而言,《法律解释学》一书突破了传统认识论的困境,从认知前提、认知场合、认知模式和认知路径等方面推动了法律解释认识论的转向,从而影响人们对法律、法律解释尤其是法律的确定性等事关法治建设的基本问题的认知,对法治建设产生深远影响。在新的认识论背景下,中国法律解释的实践任务还任重道远。Legal Hermeneutics is a representative work of Professor Zhang Zhiming,which absorbs the latest intellectual resources of philosophical hermeneutics and linguistic philosophy,and draws lessons from the experience of Western legal interpretation and constructs the system of legal hermeneutics.From the perspective of epistemology,the book Legal Hermeneutics breaks the dilemma of traditional epistemology,and promotes the shift of legal epistemology from cognitive perspectives,cognitive occasions,cognitive patterns,and cognitive paths,thus influencing people＇s attitude and understanding to law,legal interpretation,especially the legal certainty and other issues related to the construction of the rule of law.In the context of the new epistemology,the practice of Chinese legal interpretation of the task also long way to go.
