摘　　要：中国参与北极事务,实现中国在北极地区的权益,建立在"义利并举,以义为先"的义利观基础上。国际法以其规范性和合作性特点确保中国参与北极事务义利观的实现,为中国发展人类命运共同体成为国际法新原则提供机遇。中国以北极利益攸关国身份,以全人类共同利益为衡量标准,顺势促进符合全人类共同利益规则遵守,引势带动符合全人类共同利益规则构建,加强符合全人类共同利益规则的国内法保障。积极参与北极事务相关国际体制建设和机制创新,在双边层面,可开展与北极国家的合作以求共赢;在多边层面,将中国北极利益嵌于全人类共同利益之内,形成关注北极事务的人类命运共同体;分阶段有序实现海洋强国战略背景下的北极方略。There is solid international legal basis for China＇ s participation in the Arctic affairs, which will help realize China＇ s rights and interests in the Arctic. Along with the Arctic ice melting, China has the inter- ests in the field of shipping, resources exploitation, marine scientific research, activities＇ security, and also bears the responsibility in the field of marine environment protection and climate change response according to the United Nations Convention on the Law of the Sea, Svalbard Treaty and other sources of interntional law. As the Arctic stakeholder, China shall expedite the compliance with the international rules that conform to the common interests of humankind, lead the development of the international rules that respect the common inter- ests of humankind, and improve the domestic legislation to guarantee the implementation of the international rules that comply with the common interests of humankind. China will develop the participation in the Arctic affairs though bilateral and multilevel cooperation, including the cooperation with the Arctic States at bilateral level and the endeavor to respond to the climate change and protect the Arctic environment at multilateral lev- el. The good rule of law will guarantee the interests of China and the mankind as a whole. The Arctic Ocean is the area beyond the national jurisdiction, which is also the strategic domain under China＇ s Marine Power Strat- egy. The participation in the Arctic affairs by China should not be in conflict with the main goal of China＇ s marine power strategy to help realize the commonwhealth of the world in turn.
