摘　　要：《宪法解释的基本问题》全景透视了美国宪法的解释流派,其焦点最终汇集在所有解释方法的哲学前提上。在精心布局和细致批判的基础上,索蒂里奥斯·巴伯和詹姆斯·弗莱明提出了一种"哲学进路"。仔细分析和揣摩这一进路就会发现,它更像是一种态度--在政治的驯服与哲学疯狂之间微妙的平衡,一种政治与哲学之间恰当的位置。它的标准样式就是施特劳斯复兴的政治哲学。Constitutional Interpretation ： the Basic Questions gives a full understanding of the schools of A- merican Constitution interpretation. Its focus is the philosophic premise of all methods of the interpretation. After elaborately analyzing and synthesizing, Sotirios A. Barber and James E. Fleming put forward a philo- sophic approach. By carefully studying this method, it will be found that the method is more like an attitude which means a subtle balance between political conservatism and philosophic radicalism, and a proper position between politics and philosophy. The model of this attitude is the political philosophy to which Leo Strauss gave rebirth.
