摘　　要：对于人胚胎干细胞应用相关主题的发明专利申请是否符合专利法中关于伦理道德的要求,是发明专利审查的难点之一。本文根据专利法的立法宗旨及胚胎干细胞技术的发展现状,通过对复审程序中维/撤驳案件的数量、理由、变化趋势等进行分析,以期对人胚胎干细胞应用相关主题的申请和审查提供一些借鉴和参考。It＇s difficulty to reply whether the patent application involving human embryonic stem cell （hESC） meets the morality requirement of patent law. Based on the legislative purpose of the patent law and the development of hESC technology, it analyzed the quantity, reason, and variability of the reexamination decision for maintaining or revoking the reject decision of the examination division. The applicant and examiner may get some references and consults from the article to deal the invention involving the subject ofhESC application.
