传统养老对当今农村赡养纠纷解决的借鉴

摘　　要：中国传统社会官方将孝道作为法律文化的核心内容,辅以赈济和教化,在古代赡养纠纷解决中发挥着不可替代的主导作用;民间则以调解和慈善为主,弥补了国家力量触及不到的地方,官民互动如同相互咬合的齿轮,成为促进赡养纠纷解决的无限动力。随着中国步入老龄化社会,农村赡养纠纷频发,耄龄老人无所养、精神赡养被忽视的情况时有发生。面对新时期农村赡养纠纷的现实问题,考察传统官方和民间赡养纠纷的解决方式,分析其利弊得失和经验教训,可以对我们构建国家主导的新型老年权益保护法律体系,发挥基层自治组织的调解互助功能,形成以孝为先的良好社会氛围起到借鉴作用。Traditional Chinese society official will be filial piety as the core content of legal culture, supplemented by charity and enlightenment, in the ancient support play an irreplaceable role in resolving disputes; Folk is given priority to with mediation and charity, make up for the national power to reach place, officials and interactive as interlocking gear, to promote support unlimited power to resolve disputes. With China＇s aging society, rural support disputes are frequent, and there are cases of elderly people who have no access to care and neglect. Facing the reality of rural financial disputes in the new period, examine the traditional official and folk financial dispute solution, analyze its pros and cons and the experience and lessons, to build our country dominated new elderly rights and interests protection law system, the mediation of mutual functions of grassroots autonomous organizations, forming good social atmosphere with filial first for reference.
