行政主体义务保障行政抗辩权之理论基础探析

摘　　要：行政主体义务源自行政相对方权利并以行政相对方权利为目的,是行政相对方权利的根本保障。行政抗辩权是行政相对方在行政程序中的一种核心权利,它不仅是行政相对方实体权利获得保障的后盾,而且是行政相对方程序权利有效实现的关键,因此,以行政主体义务保障相对人行政抗辩权具有重要的理论价值与实践价值。以行政主体义务保障相对人行政抗辩权的正当性体现在其赖以建立的多维度的理论基础之上。近代社会契约论为其得以成立的法哲学基础;德国法上的作为客观规范或客观价值秩序的基本权利理论为其得以成立的宪法哲学基础;"行政主体义务论"为其得以成立的行政法哲学基础。Administrative subject＇s obligation stems from administrative counterpart＇s right and takes administrative counterpart＇s right for the purpose, which is the fundamental guarantee of the administrative counterpart＇s right. Right of defense in the administrative procedure is administrative counterpart＇s core right in the administrative procedure, which is not only the backing of the protection of administrative counterpart＇s substantive right but also the key to realizing administrative counterpart＇s administrative procedural right effectively. Therefore, utilizing administrative subject＇s obligation to guarantee the counterpart＇s right of defense in the administrative procedure has great theoretical value and practical value. The legitimacy of utilizing administrative subject＇s obligation to guarantee the counterpart＇s right of defense in the administrative procedure is embodied in the multi-dimensional theory foundation on which it is based. The modern social contract theory establishes its foundation of law philosophy; The basic right theory of German law as an objective criterion or objective value order establishes its foundation of constitution philosophy; The theory of administrative subject＇s obligation establishes its foundation of administrative law philosophy.
