轻罪刑事政策的个罪适用——以收买被拐卖妇女罪为例

摘　　要：《刑法修正案(九)》对收买被拐卖妇女的行为做了全部入罪的规定。然而,依据轻罪刑事政策,应当认定收买被拐卖妇女罪为轻罪,对该罪名的出入罪设定标准、刑罚设置、刑罚执行等方面应当在轻罪刑事政策指导下进行。其未来的修改方向应当包括在定罪方面制定相应的出罪标准;增加罚金刑、没收财产和法院禁止令等手段代替我国现有规定的自由刑;在司法实践中,根据不同的情况设定对罪犯是否进行监禁等,从而完善收买被拐卖妇女罪。The amendment to the criminal law(nine)amended some of the charges,including the crime of purchasing trafficked women.However,based on the study of misdemeanor criminal policy,the crime of buying trafficked women should be recognized as a misdemeanor,the set of standards for the offense,the setting of the penalty,and the execution of the penalty and so on shall be carried out under the guidance of the criminal policy.The future direction of the amendment should include the establishment of the corresponding crime in the crime of the standard.The future direction of the amendment should include the establishment of the corresponding crime in the crime of the standard,increase the penalty,confiscation of property and the court injunction and other means to replace the existing provisions of our free punishment.In judicial practice,according to different circumstances it will decide whether the criminals should be imprisoned so as to improve the details of the crime of buying and selling trafficked women.
