养殖水域滩涂规划存在问题探讨

摘　　要：利用比较、演绎等逻辑分析的方法,对养殖水域滩涂规划的性质、编制的目的、法律地位、功能与作用进行了探讨。论文研究发现,制定养殖水域滩涂规划编制的出发点,在于保护养殖者的养殖水域权,优化水产养殖空间结构的功能,然而由于配套措施不足,现实的养殖水域滩涂规划,难以实现政策设计的初衷。论文建议从法律与科学的角度深入反思养殖水域滩涂的功能与作用,并认为研究确定水产养殖水域滩涂规划的内容,制定具有科学性与可操作性的规划设计规范,是规划职能实现必不可少的条件。By ways of comparison analysis method and deductive analysis method, the characters, goals, legal status, functions of the plan of the waters and the tidal flats for aquaculture have been probed. The conclusion is that, for lack of planning guidance to formatting aquaculture water and tidal flat plan, the current plan for aquaculture＇s water and tidal flats, have no effect to protect water property of aquarist and to optimize the aquaculture space which is the achieve policy＇s initiative goal. and if it legal, it＇s necessary to make clear the contents which should be planned, as well as enact a guidance to the formation of waters and tidal fiats plan.
