摘　　要：行政强制执行的监督与制约是司法实践中的难题。行政主导型强制执行存在执行难和执行乱等问题,法院主导型强制执行由于审查方式限制、易受行政权干扰及行政非诉案件数量激增等因素影响,监督作用有限。从规范行政强制执行和弥补现有监督体系不足的角度出发,结合职能定位,以检察权来监督行政主导型强制执行和法院主导型强制执行既可实现对行政权的有效制约,也可有效保护行政相对人的合法权益,具有可行性和必要性。The supervision and restriction of administrative enforcement is a difficult problem in juridical practice. Administration- led enforcement is difficult and confused, while court-led enforcement is vulnerable to the interference from the executive power, and the supervisory role is limited due to the sharp increase of administrative non-litigation cases. In order to standardize administrative enforce- ment and make up for the existing supervision system, procuratorial power combined by function orientation can be applied to supervise both administration-oriented enforcement and court-oriented entbrcement, which can effectively restrict executive power and effectively protect the legitimate rights and interests of the administrative counterpart.
