摘　　要：农地承包经营权集合信托流转作为我国农地承包经营权流转方式的制度创新,在实践中,还存在着诸如产权主体模糊、信托财产界定不清、多重委托人主体结构和监管缺失等问题,特别是地方政府信用的介入,行政干预的加强,不仅阻碍了原生性的农地经营主体的发展,而且存在涉嫌挤压农民利益的问题,带来农村社会治理的不确定性风险。因此,应完善农地承包经营权集合信托流转的相关立法,为构建产权清晰、流转有序、监管适度的农地集合信托流转制度提供法律保障,这对我国农地经营制度改革具有重要的现实意义。The collective farmland contract and management rights trust by transfer as a innovation of the farmland contract and management rights transfer in the farmland reform system. There have many obvious obstructions and issues in practice,such as the fuzzy of property rights,the issues of ill-defined trust property,the confusion about the subject of participants and the absence of government supervision and other issues. Especially,being the local government credit involved and the administrative interference strengthened,it＇s not only hindering the development of primordial agricultural business entities but also extruding the farmers ＇interests,bring the uncertainty risk to the rural community of social governance. Therefore,it has important practical significance to rebuild the system of our country ＇s agricultural farmland management and reform,by improving the legislation of the collective farmland contract and management rights trust by transfer,to build a farmland transfer system with the feature of clear property right,moderate supervision and ordered-transfer,providing a legal protection to safeguard farmers＇ interests.
