摘　　要：一个新的国际法分支在冷战结束后逐渐形成,被称为"承认的国际法"(droit international de la reconnaissance)。它纳入了1990年以来同时出现在各国国内和国际社会上的新的社会和文化范式:对身份认同的承认。这种新国际法产生于冷战后国际社会对去殖民化历史的积极反省之特定背景中。目前,承认的国际法已经体现在各种国际条约和国家行动之中,并且因此成为实证国际法的一部分。传统国际法中存在国家中心主义偏见,强调物质补偿,因而无法完全满足这一国际法上新分支的诉求。Following the cold war, the global society has had to face cultural and Identity claims wmcn have created new tensions within legal equality and cultural differences. Indeed, disadvantaged states, but also minorities of all kinds （natives, ethnic groups and women） , feeling stigmatized, tend today to have their own dignity, their identity and also their specific rights acknowledged. Some of them are even looking for compensation arising from infringements of their identities and forfeiture of their properties. To provide an answer to those claims, subjects of the international society have built up a new area of law called the ＂international law of recognition＂ ~ The aim of this article is to give rise to such an evolvement and to spot legal practices related to this new right of recognition. Consequently, the author offers to submit their presuppositions and their implications to a critical analysis.
