安理会授权使用武力机制合法性与有效性关系问题分析

摘　　要：安理会授权使用武力机制是在《联合国宪章》第43条"特别协定"无法订立、第42条"空海陆军行动"没有武装力量支持的情况下,安理会根据《联合国宪章》第七章,将武力强制行动的执行权交由会员国或区域组织代为行使的变通方法,是联合国集体安全机制的武力执行机制。但是,作为一种非正式机制和派生机制,该机制的合法性与有效性关系存在问题:一方面,机制合法性不足影响了有效性的发挥;另一方面,机制有效性不足也削弱了机制的合法性。本文认为其原因既是法律的,也是政治的,需要在决策机制、决议文本、行动保障和评估反馈等方面进行完善。The mechanism whereby the UN Security Council to authorize the use of force in accordance with Chapter VII of the Charter of the United Nations is a way of accommodation to circumstances by delegating the right to apply force measures to the Member States or regional organizations instead,and is a force enforcement mechanism for the United Nations collective security system,under the circumstances in which a special agreement or agreements cannot be concluded in accordance with Article 43 of the Charter.As an informal mechanism and a derivative mechanism,however,the relationship between the legitimacy and the effectiveness of the mechanism is problematic:on the one hand,the lack of legitimacy of the mechanism affects the effectiveness to be maximized;on the other hand,the lack of effectiveness of the mechanism also weakens the legitimacy of the mechanism.This paper argues that the reasons are both legal and political,and the mechanism needs to be improved in terms of decision-making mechanism,resolution texts,action supports,and evaluation feedbacks.
