国外铁路监管机构探析

摘　　要：为推动我国铁路监管机构监管职责与监管手段的完善,剖析国外铁路的监管机构的设置形式、监管职责及监管手段。将不同监管机构的监管领域归纳为安全、市场和资金3类,阐述相应的监管职责;将监管手段归纳为法律类、管制类和信息类3类,分析不同监管领域的主要监管手段。在此基础上,结合我国铁路行业监管现状,提出加强监管机构组织建设、强化铁路宏观监管职能、创新监管手段等完善我国铁路监管的对策。With the purpose of improving the supervision functions and measures of railway supervision authority in China, this study reviews the organization structure, functions and measures of foreign railway supervision authorities. It finds that railway supervisors＇ roles lie in three areas, namely, safety supervision, market supervision, and funds supervision. Then the supervisors＇ different roles are elaborated accordingly. It also reveals that railway supervisors combine legal, regulatory and information supervision means to fulfill their responsibilities. Based on the supervision reality in China, this study further provides some insights for improving railway supervision in China in terms of strengthening organization construction, intensifying railway macro supervision roles and innovating supervision measures, etc.
