论我国网络赌球治理的困境与对策

摘　　要：我国对网络赌球规制的相关法律规定不健全,使司法实践存在着诸多困境,表现为在惩处普通赌客时力度较轻,缺乏威慑力,而在惩处足球相关从业者、第三方支付商时又缺乏合适的罪名等。对于利用网络进行赌球这一严重危害社会的行为,法律也没有规定从重处罚的量刑情节,对于网络赌博的打击仍然存在不少盲点。需要完善现有立法、创新监管机制,从而杜绝网络赌球的发生。The current laws and regulations related to online gambling is not perfect, which caused a lot of difficulties in practice.The punishments on gamblers are rather light and lack deterrence. There＇s neither a proper crime name for punishing football-concerned practitioners or the third-party payers, nor a heavier punishment for online gambling which seriously does harm to the society. Still there are a lot of blind spots for the fight against online gambling. The legislation needs to be improved and the regulatory mechanisms should be innovated, so as to prevent the occurrence of online gambling.
