摘 要:在解决劳动争议的选择上,我国通过嫁接商事仲裁制度,形成国家强制干预纠纷解决的劳动仲裁前置制度。劳动争议前置程序的立法初衷是好的,但随着司法实务的不断推进,目前的劳动争议仲裁前置机制存在诸多弊端。为此,劳动争议仲裁前置程序在实务及理论方面都有所矫正。综合劳动争议仲裁及司法实践的新形势,建议我国劳动争议仲裁前置程序应当进行大胆改进,劳动仲裁机构的功能应当由裁决向调解进行转变。In the choice of labor disputes, China has adopted the system of commercial arbitration to form a pre-placement of labor arbitration for state compulsory intervention disputes resolution. The original purpose of pre-placement of labor dispute is good, yet current mechanism has many limitations as judicial practice goes on. In this context, the practice and theory of the pre-placement of labor dispute arbitration should be rectified. Under the current new situation of labor dispute arbitration and judicial practice, it is proposed that China's pre-placement of labor dispute arbitration should be ameliorated boldly and the function of labor dispute arbitration organ should be changed from arbitration to conciliation.
