摘 要:改编权作为著作权人一项重要的财产性权利,其范围的界定和立法模式的选择直接关系到以原作品为基础进行后续创作的合法性认定。只有在认定改变原作品的行为侵犯改编权的基础上,才能对后续创作是否构成合理使用进行认定。鉴于目前我国影视行业出现的多起改编作品引起的侵权案例,我们有必要从作品市场和权利人收益的角度考量改编权的范围和适合的立法模式,以期为我国第三次著作权法的修订提供学理支撑和立法建议。The adaptation right is an important property right of the copyright owner.The scope of the adaptation right and its legislative approach are directly related to the legitimacy of the subsequent creations based on the original work.Only on the basis that the adaptation right is infringed can the practitioners further determine whether the subsequent creations constitute fair use.In the light of current copyright infringement cases concerning adaptation of works in China’s film and television industry,this article discusses the scope of adaptation right and its legislative approach in the perspective of market of works and commercial gains of copyright owners.The discussion and suggestion aim to provide academic support and legislative advice for the third amendment of copyright law in China.
