边境贸易纠纷解决机制创新探析

摘　　要：在我国边境贸易快速发展进程中,受贸易双方法律意识淡薄、灰色清关等负面因素影响,边境贸易纠纷日益增多。一方面,诉讼、仲裁与调解协调等边境贸易纠纷解决机制本身存在诸多缺陷,另一方面,由于司法合作机制不健全,各种纠纷解决机制存在无法适用的问题。基于这种状况,必须着力创新边境贸易纠纷解决机制,在完善已有解决途径、解决灰色清关顽疾、加强双边司法交流等方面作出努力。During the rapid development of China＇s border trade, affected by weak legal consciousness of the two parties and grey custom clearance, the border trade dispute was growing day by day. On one hand, lawsuit, arbitration and coordina- tion and other border trade dispute solving mechanism had a lot of defects, on the other hand, due to the incomplete judicial cooperation mechanism, the dispute solving mechanism had unsuitable problems. Based on the situation, we must strive to in- novate border trade solving mechanism, and make effort in improving the current solVing path, solving grey custom clearance and enhance dual judicial cooperation.
