摘 要:南昌临空经济区作为国务院批复成立的第18个"国家级新区"(赣江新区)的重要组成部分,其战略定位是建成中部地区重要航空枢纽和对外开放门户、长江中游高端产业集聚区和绿色智慧空港、鄱阳湖生态经济区先导区和改革创新示范区、昌九一体化发展的战略支点和强力引擎。在这一定位下,南昌临空经济区的法制建设与经济发展本可以共存达到良性循环,但在中国渐进式改革进程中,法律制度往往被看成是改革的负担,并由此形成了目前中国改革中特有的"实践先行"现象。通过对南昌临空经济区的法制现状及现存问题分析,在总结国内外区域经济发展实践经验基础上,提出了加速南昌临空区建设发展的法制保障路径,以期在法制框架内利用现有资源来化解上述"矛盾"。Nanchang airport economic zone is served as an important component of the eighteenth "national new district" (Ganjiang New District) officially established by State Council, of which the strategic positioning is the significant aviation hub and opening site in central zone, Yangtze River midstream advanced industrial cluster zone and green intelligent airport hub, Poyang Lake ecological economic guidance zone and reform innovatinve demonstration zone and strategic point and strong engine of Nanchang-Jiujiang integration development. Under the strategic positioning, the legal construction and economic development of Nanchang airport economic zone should have achieved virtuous cycle, but during the gradual reform progress of China, the legal system is always considered as the reform burden, and it also formed the unique "practice in advance". By analyzing the legal status quo and existing problems of Nanchang airport economic zone, based on summarizing the domestic and foreign regional economic development practice experience, this paper puts forward to accelerate the legal guarantee path of construction of Nanchang airport zone and hopes to solve the conflict by using the current resources.
