摘 要:美国决定对中国发起"301条款"调查,意味着"301条款"的复活。"301条款"是美国在WTO之前建立的对美国实行不公正贸易行为的国家实行贸易报复的措施,具有浓厚的保护主义色彩和单边主义的性质。它显然与WTO的多边主义格格不入,在WTO时代遭受了WTO合规性挑战。但WTO的争端解决机构及其专家组在欧盟诉美国"301条款"案中进行妥协,以不对抗WTO及争端解决机构的规则为前提容忍了其继续存在,为"301条款"的复活留下了后患。特朗普当选为美国总统后,这一后患变为现实,中国成为第一个对象原因很复杂,必须认真对应。The United States decided to initiate "Section 301" investigation to China. This means the resurrec- tion of "Section 301 Section 301" was enacted before the WTO was established, and used to retaliate against those countries that practiced unfair trade behavior measures for trade of US, with strong protectionism color and the nature of unilateralism. It is clearly out of tune with WTO muhilateralism, suffered WTO compliance challenges in the WTO era. But the Dispute Settlement Body of WTO and the panel in the EU v. U.S "Section 301" case compro- mised, and tolerated it to continue to exist As long as not against WTO and DSU rules as a prerequisite. This left the future trouble of the resurrection of "Section 301" became a reality after Trump was elected president of U.S..The reasons that Chinabecame the first object of Section 301 are very complex. We must be seriously correspond.
