略论少数民族传统医药知识的生产性保护

摘　　要：少数民族传统医药知识的生产性保护是指在保持传统医药核心知识与技艺的基础上,尽可能对传统诊疗法、传统医药药物炮制技艺、传统保健习俗等传统医药知识进行创新、开发与利用并转化为消费品,最终实现传统医药知识传承、人类身心健康维护与经济社会发展共赢的一种保护模式。少数民族传统医药知识的生产性保护应坚持分类开发、原真性与创新性相协调、主体利益共享原则,要做好全面普查和完善相关制度建设,妥善处理好传统医药知识生产与保护、知识产权归属与惠益分享、药物资源获取等问题。Productive protection of minority traditional medicine Knowledgeis a protection mode that refers tokeep the core knowledge and skills of traditional medicine,and innovate, develop and utilize traditional medicine knowledge such as the traditional treatment method, traditional medicine drug processing skills, traditional health care practicesas such as possible,and translate into consumer goods,finally realizes the traditional medicine knowledge inheritance,human body and mind health maintenance and win-win economic and social development.ethnic minority traditional medicine knowledge productive protection should adhere to the principle of classification development, harmony between authenticity and innovation,and sharing of principal interests,should be comprehensive survey and perfect the related system,properly deal with traditional medicine knowledge production and protection,intellectual property right and benefit sharing, drug resource acquisition and so on.
