摘  要:互联网金融的私法规制侧重于纠纷解决、权益救济与规则塑造,在产业需要、社会效果和法律实施等多个层面均有公法规制不可替代的价值与优势。以"电商+网贷"为代表的大学生网络信贷消费迅猛发展、"双刃剑"效应突出,而当下强化公法规制的效果有限且负外部性明显,应探索相应的私法规制路径。大学生在法定层面的民事行为能力与其在实践层面的消费认知能力之间存在不同程度的落差。应采取类型化规制的方法,针对特定范围的商品和服务,从合同法的角度将与大学生消费认知能力明显不相适应的买卖合同归结为效力待定合同,并从消费者权益保护法的角度适当延长大学生行使合同解除权的时限。Private law regulation on the internet finance focuses on the dispute resolution, the interests of relief and rule shaping, so that comparing to the public law regulation, it shows irre- placeable value and advantages in the view of industry needs, social effects and the implementation of laws. As the electronic business plus internet loan develops rapidly, the "double-edged sword" effect is also prominent, while the effect of strengthening the regulation of public law is limited and its negative externalities are obvious, which forces us to explore the corresponding private law regula- tion path. There is a gap between college students' legal level of civil capacity and their practical level of consumer cognitive ability in varying degrees. We should adopt the method of typified regu- lation, for the specific range of goods and services, from the perspective of contract law, the con- tracts with which college students' consumption cognitive ability is clearly incompatible should be at- tributed to the effectiveness of pending contracts, and from the perspective of consumer rights protec- tion law, we should extend the time limit for college students to exercise their rights to terminate the contracts.
