执行程序中债务人异议审查制度研究

摘　　要：执行问题是公民通过诉讼实现自己权利的最后一步,如何高效而又全面地保障当事人的合法利益是一个需要执行人员运用智慧解决的难题。法院在对执行机关的执行行为监督时,往往存在一部分本不该进入执行程序的案件,或者当其他实体事由的出现,应当及时退出执行程序的案件,对于这些案件需要一套合理高效的退出机制,通过进行债务人异议审查,从一开始就排除应当退出执行程序的案件,全面解决实践中执行难的问题。Implementation issues are the last step of citizens protect their rights through litigation,how efficient and comprehensive protection of the legitimate interests of the parties will be a big problem and need personnel use wisdom to solve that. there are often part of this case probably shouldn't be in the execution of the program,or if the emergence of other entities,should quit the program in a timely manner cases,these cases require a reasonably efficient exit mechanisms,through the debtor's objection review Excluding the cases in beginning. Comprehensively solving the difficult problems in practice.
