摘 要:康托洛维茨置独体法人概念于《国王的两个身体》的导论中。作为"法人学说"和"独体法人"概念先驱的"活的法"概念,在《国王的两个身体》"弗里德里希二世"一节中极具绝对主义色彩,被"布莱克顿"一节对《王权法》帝国立法权利来源的宪政主义解释所颠倒。换言之,"活的法"概念被康托洛维茨作为潜藏要素整合进宪政主义的架构当中。不过,如果随着世俗化进程的加剧,宪政主义的神学色彩脱落,那么,"活的法"在宪政主义架构中便成为冗余。反之,如果在后世俗时代,神学和政治之间存在永久的乡愁,康托洛维茨的整合便是成功的。Ernst Kantorowicz situates the corporation sole in the introduction of The King's Two Bodies.As the conceptual forerunner of universitas andcorporation sole,lex animata is an absolutist doctrine in the section "Frederick the second"of The King's Two Bodies.It is then reversed by Kantorowicz as a concept of constitutionalism in next section"Bracton".In other words,as the hidden element lex animata is successfully inserted intothe framework of constitutionalism in the law-centered kingship.However,if the theological color in constitutionalism fades out with the intensification of secularization,lex animata will have no place in constitutionalism.On the contrary,politics may always have an air of religious nostalgia,so Kantorowicz's endeavors for this integration conform to the trend of post-secularism.
