摘  要:行政法的理论基础问题一直是行政法学界最为基础、关键却又最具争议的问题。长期以来,行政法学界对此问题进行了不懈的研究和努力,提出了诸多理论观点和学说。文章以法律的本质特征为研究视角,分别针对学界传统的"管理论""控权论"以及"平衡论"等理论观点和学说进行了分析,并结合我国国情和经济社会发展现状进行理论反思,进而提出我国行政法的理论基础当为"公共利益本位论",该学说较适合我国国情,更能体现我国行政法的发展方向和现代行政法的发展趋势。The theoretical basis of administrative law has always been the most basic , crucial and controversial issin the field of administrative law. For a long time , the administrative law circle has made unremitting research andefort on this issue , and put forward many theoretical views and doctrines. Taking the essential characteristas the research perspective , the author makes an in - depth analysis through some traditional theoretical views anddoctrines in the academic circles , such as “management theory” ,“theory of power control” , and “balance theory” ,conducts theoretical reflection combined with Chinas national conditions and the present economic and social development,and then puts forward that “the theory of public interest standard” should be the Chinas administrative law,which is more suitable for the national conditions of our country and can reflect the de-velopment direction of Chinas administrative law and the development trend of modem administrative law.
