上海公共租界会审章程的制定及其实际作用——基于英国国家档案馆档案的研究

摘　　要：上海公共租界会审章程的制定标志着中外会审制度在中国建立,它的实施表明近代中国司法主权的进一步丧失。然而从洋泾浜北首理事衙门章程草案到会审章程草案,再到会审章程的最终确定,这整个过程充满着中外双方的折冲与博弈。洋泾浜北首理事衙门章程草案、会审章程草案这两个新发现的章程稿本为我们提供了诸多细节,尽管处于两次鸦片战争之后,中国的主权正日益丧失,但当时的总理衙门及上海的地方政府在维护司法主权方面却并非毫无作为,即使就会审章程的作用来看也不都是负面的。The formulation of the Rulesmarked that the Mixed Court had already been set up in China,as well as indicating that the modern China’s loss of judicial sovereignty was furthered substantially.But on the other hand,the production of the Rules was a historical game involving China and foreign countries.This point can be corroborated by two newly-discovered drafts in relation to the final Rules.New materials reveal that,contrary to the stereotyped opinion,although China at that time just suffered humiliating fiascos in the two Opium Wars and her sovereignty were encroached day by day,zongli yamen,or then the Ministry of Foreign Affairs,and the local authorities of Shanghai did try their best to defend the country’s judicial sovereignty.Even the detailed stipulations of the Rules were not entirely passive and negative.
