摘 要:船员违反水上交通运输管理法规,因而发生重大事故的,应当适用刑法交通肇事罪追究其刑事责任。但水上交通与道路交通相比有其自身特点,适用刑法中交通肇事罪条文可能出现不适应性,集中体现在人员失踪为经常性后果,事故后果呈现严重性、特殊性等,对人员失踪不能简单推定为死亡,也不能视为独立的危害后果,对人员伤亡与财产损失应按水上交通事故的实际情况提高入罪门槛,对致水域污染的,应作为独立的危害后果入罪。船舶所有人或管理人的监督、管理过失责任也不应忽略。The crew should bear criminal responsibility when violating the regulation of water transportation administration and causing serious accidents. However,because of their different characteristics,provisions of road traffic accident in criminal law may not be fit for the water traffic accident,in that the consequence of missing persons is frequently involved,which is both serious and special because the disappearance of persons cannot be taken as presumed death,nor can it be considered as an independent consequence. The threshold of casualties and property losses should be raised for the crime of water traffic accidents. Those causing water pollution shall be regarded as an independent endangering crime. The supervision and administration of the shipowner or ship manager shall not be neglected as well.
