保障雄安新区创新驱动的知识产权司法政策研究--以职务发明制度为中心

摘　　要：雄安新区的战略定位是创新驱动引领区,其重点在于提升创新研发能力。职务发明是科技成果的主要来源,职务发明制度关系国家对科技创新人才激励机制的政策导向,对雄安新区创新驱动引领区的建设发挥着至关重要的作用。职务发明制度内部包含着两方面的冲突,一是发明单位与发明人之间的利益冲突;二是国家公权力干预与企业自主经营权之间的冲突。在这两个冲突之间,现有职务发明制度存在着单位优先主义盛行和公权力介入过度的问题。在立法尚未对创新做出激励性调整之前,司法可以进行适当调整。在立法的过程中,发明单位的声音过于集中,容易影响立法,而发明人的声音过于分散,很难参与立法。因此在立法过程已向发明单位倾斜的情况下,为实现平衡,司法过程应当向发明人进行适度倾斜。通过实现发明人、发明单位、社会公众之间的利益平衡,增强雄安新区对人才和研发性企业的吸引力,保障其研发战略功能定位的实现。The strategic position of Xiongan New Area is to be an Innovation-driven leading area, whose emphasis is to enhance innovation and R ＆ D capabilities. Service invention is the main source of scientific and technological achievements. The Service invention system is related to the state＇s policy orientation of the incentive mechanism to the scientific and technological innovation talents, and thus plays a vital role in the construction of the innovation-driven leading area of Xiongan New Area. There are two kinds of conficts in the Service invention system： one confict is about the interest between the employer and the inventor, while the other one is between the state＇s public power intervention and the right of independent operation of enterprises. There are problems like the prevalence of employer preference doctrine and the excessive intervention of public power in the existing service invention system. Before the legislation has made an incentive adjustment to the innovation, the judiciary can make some appropriately adjustment in advance. In the process of legislation, it is easy to affect the legislation if the voice of the employer is concentrated, but the inventor＇s voice is too dispersed. Therefore, under the situation that the legislative process has already tilted to the employers, the judicial process should moderately incline to the inventors so that balance can be achieved. By realizing the balance of interests among inventors, employers and the public, the attraction of Xiongan New Area for talents and R ＆ D enterprises will be enhanced, and the strategic functions of R ＆ D will be guaranteed.
