法官检察官薪酬结构中养老保障制度的设计与优化

摘　　要：在员额制改革背景下,法官检察官的养老保障制度改革落后于总体改革趋势,与其单独职务序列改革不配套,不能从薪酬保障、养老保障方面支撑员额制改革的推进。同时,我国的法官检察官养老金目标替代率明显低于国际标准与其他国家,不仅无法实现通过优厚养老保障制度提升现行薪酬水平的目标,而且也无法起到有效的激励与约束作用。因此,调整法官检察官薪酬结构是完善其职业保障体系、提高其生命总体预期收入的必然要求。我国可在综合考虑法官检察官当期收入与一生保障的基础上,构筑职业年金方案,在其薪酬结构中考虑和设计弹性退休制度,并参照居民消费价格同比增长指数对法官检察官养老金进行动态调整。Under the background of the reform of the post system,the reform of the retirement pension system of the judge's prosecutor falls behind the general tread of reform.It is not compatible with the reform of the individual post sequence,and can not support the reform of the post system in the aspects of compensation guarantee and old-age security.It is not compatible with the reform of the individual post sequence,and can not support the reform of the post system in the aspects of compensation guarantee and retirement pension.In addition,the replacement rate of the pension target of the prosecutor in China is obviously lower than that of the international standards and other countries.It is not only impossible to achieve the goal of improving the current salary level through the good old-age security system,but also can not play the role of effective incentives and constraints.Therefore,the adjustment of the compensation structure of the judge's prosecutor is the necessary requirement to improve its occupational security system and the overall expected income of its life.Our country can construct occupational pension scheme on the basis of comprehensive consideration of the income and life guarantee of the judge prosecutor in the current period.The elastic retirement system is considered and designed in its salary structure,and the judge's pension is dynamically adjusted according to the year-on-year growth index of the consumer price.
