摘 要:第三方调解机制与医疗责任保险都具有缓解医疗纠纷矛盾之功能,各地政府尝试将两种措施进行融合,虽然取得一定成效,但是两种措施分属于不同主体,而这两个主体又具有不同的服务目标,融合发展具有一定难度。如何将这两个主体的服务目标糅合并达到构建和谐医患环境的目的,成为制度构建者需要思考的问题之一。笔者通过调研国内比较成功的第三方调解机制与医疗责任保险融合的模式,分析并总结经验与不足,认为我国应在宏观上进行立法引导,协调两者关系,进而达到高效化解医疗纠纷、缓和医患矛盾的目的,同时不断促进医学发展。The third party mediation mechanism and medical liability insurance has the function of relieve the contradictions of medical disputes; local governments try to integrate the two kinds of measures. Although it has achieved some success, but two kinds of measures belong to different main bodies, and the two main bodies have different service targets, which make fusion development has the certain difficulty. How to blend the two main service objectives and achieve to constructing the harmonious medical environment, which is one of the problems that system builders need think about. Researching domestic successful fusion model of third-party mediation mechanism and medical liability insurance, analyzing and summarizing experience and deficiencies, proposing our country should legislate to make macro guidance, and coordinate the relationship of them, and then to achieve high resolving medical disputes, and ease the contradiction of doctor-patient, and promote medicine to develop continuously.
