摘　　要：ICSID是目前解决因国际投资引起的法律争议的主要仲裁机构,其仲裁管辖权以当事国的同意和适格投资的认定为基础,但二者之中争议较大的是适格投资的判断。结合ICSID案例来看,投资条约对投资的定义包括一般意义和法律意义上的定义,同时,ICSID管辖权下适格投资应具备一定条件。基于此,我国应当准确把握适格投资判断标准未来的发展趋势。International Centre for Settlement of Investment Disputes （ICSID） is the major arbitration institutions of international investment disputes. The arbitration jurisdiction is based on the consent of the parties and the confir- mation of the qualified investment. However, the dispute is the judgment of the qualified investment. In the case of ICSID, the definition of investment in investment treaties includes general and legal meaning, on this basis, quali- fied investment should have certain conditions under the jurisdiction of ICSID. China should accurately grasp the future development trend of qualified investment judgment standard.
