价值理性视角下我国特大安全事故行政问责探究

摘　　要：基于价值理性的视角,本文提出了我国特大安全事故行政问责分析框架。借助于搜集到的1998-2016年的一些特别重大安全事故的案例,运用spss20软件,采用LOGIT分析方法,从价值理性层面进行分析,检验了问责对象的层级、问责事由等对问责形式的影响,事故死亡人数、事故类型、媒体关注度等对是否有副厅局级以上人员被问责的影响。研究发现,过责一致原则在问责中没有得到应有的体现,问责事由对问责形式影响不显著;层级对问责的影响显著,但这种影响是反向的,基层人员相对于高层人员更容易被重度问责;媒体关注度对是否有副厅局级以上人员被问责的影响显著。这一探究表明,我国特大安全事故行政问责公平性有待提升。因此,我国安全事故行政问责应坚持以价值理性为导向,既要考虑外部的回应性,又要重视内部的权责一致和过责一致等规则,从客观出发,向公平迈进,构建一个有机合理的行政问责系统,实现问责的公平与理性。Based on the viewpoints of value rationality, this paper puts forward the framework of administrative accountability analysis of extraordinarily serious accidents in China. By using the spss20 software, using the LOGIT analysis method to test the impact of the level of accountability object and other reasons on the form of accountability, and the impact of the number of accident deaths, the type of accident and Media attention on whether there is a person at or above deputy bureau level is accounted. The study found that the principle of fault-accountability consistency has not been reflected, the impact of accountable reasons is not significant on the form of accountability; level of accountability is significant, but the impact is reversed, and the grassroots relative to high-level personnel are more likely to be seriously accountable; media attention on whether a deputy bureau level or above is accounted was significantly affected. This research shows that the fairness of administrative accountability should be improved in China＇s extraordinarily large security incidents. Therefore, the administrative accountability of China＇s security accident should be guided by the rationality of value, not only to consider the external response, but also pay attention to the internal rules such as powers and responsibilities consistency and fault and liability consistency, and from the objective to the fairness, to build an organic reasonable administrative accountability system, to achieve accountability fairness and reasonality.
