摘　　要：知识产权性徽州历史文化包括徽州民间文艺、徽州传统技艺和徽州老字号三种类型,并分别蕴含着以著作权、专利权和商标权为主的知识产权利益及防止被不当商业利用的共同知识产权利益。徽州历史文化知识产权利益的实现主要通过知识产权各部门法对利益进行初次的归属分配,在此基础上,需要兼顾权利主体的精神权益,并辅之以必要的地方行政和司法手段。The intellectual historical culture of Huizhou is classified into three types： Huizhou folk arts, Huizhou traditional crafts and time-honored Huizhou brands, which respectively contain the intellectual property interests with copyrights, patents and trademark rights as their main body and shared intellectual property interests that are to prevent improper commercial use.
