摘　　要：基于对政府推进型法治模式的反思,我国提出了"法治国家、法治政府、法治社会一体建设"的新思路。由此,法治社会建设被确立为法治中国实践的重要组成部分。法治社会范畴涵摄价值、秩序、制度和观念四个维度的面向,其中价值之维代表着法治社会所欲图实现的价值理想,表达社会主体追求幸福生活的基本主张;秩序之维体现法治社会的有序状态,特别强调社会本身的自我秩序化能力;制度之维为社会主体的交往提供多元化的行为规范和纠纷解决机制,使国家法律体系获得有效的制度补充;观念之维是社会主体的法治意识以及社会整体法治文化的反映,在社会行为与法律制度之间提供必要的观念场域。法治社会四维面向的并存,构成了法治社会范畴的基本特征。Based on the reflection of the model of the government＇s promotion over the past thirty years, our ruling party puts forward a new idea of ＂the construction of the country based on the rule of law, the government based on the rule of law, the society based on the rule of law＂. Thus, the construction of the society based on the rule of law has been established as an important part of the practice in China. The concept of the society based on the rule of law includes four aspects： value, order, system and idea. The value represents the ideal value of the society, and express the basic idea of the social subject＇ s pursuing of the happiness; the order reflects the orderly state of the society, with particular emphasis on the ability of the social self; the system provides a variety of behavior norms and dispute settlement mechanism for the communication of the social subji^cts, which makes the national legal system obtain effective institutional supplement; the idea is the reflection of the legal consciousness of the social subject and the whole legal culture of the society, which provide the necessary conceptual field between social behavior and legal system. The four- dimensiong coexistence of the society based on the rule of law constitutes the basic characteristics of the category of the society based on the rule of law.
