摘 要:将自侦权从检察机关剥离出来,转隶国家监察委员会,是国家监察体制改革的重要内容。这项改革不仅是构建专门反腐败体制的需要,也是检察机关回归其宪法定位之需要。在法理上,自侦权并非典型意义上的法律监督权,但在实践中,自侦职能却俨然成为了检察机关的主业,而法律监督职能反而成为了副业,由此导致检察机关偏离了法律监督机关的宪法定位。故此,剥离检察机关的自侦职能,正是修正检察制度,让其回缚于法律监督机关定位之重大举措。为平抑自侦权剥离之后的功能性失衡,检察机关将被赋予公益诉讼职能。藉此,国家法律监督体制将实现重构。It is an important part for the reform of the national supervision system to separate the procuratorial investigation power from procuratorate and transfer this power to the Committee for Inspection of State Affairs. This reform not only meets the requirement of building a special anti-corruption system, but also helps the procuratorate to fulfill its duty as the Constitution describes. As far as jurisprudence is concerned, procuratorial investigation power is not a typical legal supervision power. However, self-investigation has become the main work for procuratorate in practice.Meanwhile, the procuratorate" s legal supervision function has been overlooked, which leads to the departure of procuratorate from its constitutional position of legal supervision organ. Therefore, separating self-investigation function from the procuratorate is an amendment of the procuratorial system. It is an essential step for the procuratorate to restore its position of the legal supervision organ. After the separation of procuratorial investigation power, procuratorate will be given the function of public interest litigation to preserve the functional balance. Thus the national legal supervision SYstem will be reconstructed.
