中国国际河流法律政策探析

摘　　要：国际河流的开发利用与保护对中国及其他相关流域国的可持续发展具有重要影响。本文剖析了中国关于国际河流的法律政策,探讨了《国际水道非航行使用法公约》生效对中国的现实及潜在影响,并在顺应国际水法发展趋势、借鉴现代国际水法基本理论、遵守国际水法基本原则的基础上,提出了关于中国国际河流开发利用与保护的若干建议,包括拓展国际河流条约、完善中国关于国际河流的法律政策等。The development,utilization and protection of international rivers have important influence on the sustainable development of China and other riparian countries concerned.The authors analyzed Chinese laws and policies on international rivers in this paper in view of the issues existing in the development,utilization and protection of international rivers in China.On the premise of complying with the development trend of international water law,drawing lessons from the basic theories of modern international water law and abiding by the basic principles of international law,the authors analyzed the potential impact of the entry into force of the＂Convention on the Law of the Non-navigational Uses of International Watercourses＂on China＇s realities.In addition,the authors put forward several recommendations on the development,utilization and protection of international rivers in China,including expanding international river treaties and perfecting Chinese laws and policies on international rivers.
