摘　　要：我们可以从正当性角度对国家进行评价,也可以从正义的角度出发来评价。那么,国家正当性与国家正义是何种关系?从正义这种美德或规则在人类社会合作中的地位来看,同时也从国家对社会合作的深远影响来看,国家正义是国家正当性的必要条件。与此同时,一个国家若要是正义的,就必须至少满足两点要求,即尊重人们的基本自由和权利,并且要平等尊重人们的基本自由和权利。考虑到国家正当性与国家正义之间的逻辑关系,这两点当然也构成国家正当性的前提条件。We can evaluate a state from two perspectives,which are related its legitimacywhat is the relationship bet-ween state legitimacy and state justice？ This paper aims to prove that state justice is the necessary precondition of state legitimacy. This is mainly for two reasons： one is linked to the key role of the virtue or rules of justice in social cooperation among persons, and the other concerns the deep and pervasive effects of state on social cooperation. Moreo-ver, to be just,a state must at least fulfill two conditions： it must respect the basic liberties and rights of human beings,and it must treat the two equally. In view of the relationship bet-ween state legitimacy and state ously essential to the establishment of state legitimacy.
