以审判为中心背景下侦查思路的选择

摘　　要：以审判为中心,就是要扭转以侦查为中心的局面,以法治社会的价值选择为前提,限制侦查权的行使。侦破案件是一个还原案件本真的过程,也是一个对行为人或者犯罪嫌疑人的行为进行具体分析,初步确定罪与非罪、此罪与彼罪的过程。受刑法"四要件"理论的影响,侦查实践中常用的"平面"式的思维方式,无法体现定罪过程,也不利于保护嫌疑人的合法权益。因此,我们提倡"阶层"式的思维进路,即,对于具体案件的侦查思路应展现出由事实到价值、由形式到实质、由客观到主观的判断过程,应是层层递进、环环相扣的阶梯式进行的思维演进过程,并在此基础上,规范侦查人员的执法行为,依托大数据,采用科学有效的方法,依法全面、真实地收集、审查和固定证据。Taking the trial as the center to replace the investigative centered model, which purpose is subject to the value orientation of the rule of law for limiting the power of investigation in modern society. Investigating a case is a process of restoring the truth as well as a concrete analysis of the behavior of a perpetrator or a criminal sus- pect, which is the preliminary determination whether the behavior constitutes a crime and what the concrete accusa- tion is. Influenced by the theory of＂ four elements of the crime＂, the＂ flat＂ mode of thinking that people formed in the course of the practice of investigation cannot reflect the process of conviction and protect the legitimate rights and interests of the suspects. Therefore, we advocate the＂ stratified＂ way of thinking, which is, the investigation of specific cases should show the deterministic process from fact to value, form to essence, objective to subjective, as well as the layer-layer progressive, interlocking and stepped process of thinking evolution. Also on the basis of that, we should standardize the law enforcement of investigators, rely on the Big Data and adopt scientific and ef- fective methods fully and truthfully collect, review and fix the evidence in accordance with the law.
