摘 要:由于"非物质文化遗产保护"与"民间文学艺术作品著作权保护"的中文译名共同使用了"保护"一词,许多学者误以为这两种保护是同一性质,实际上其英语表述及内涵均有本质区别。前者是由联合国教科文组织主导的基于"人类共同遗产"理念发展出来的保护制度;后者是由世界知识产权组织主导的基于"私有制财产"理论建立起来的保护制度。我国在非遗保护中的杰出成就,以及在"民间文艺著作权保护"领域的踌躇不前,进一步证明了非物质文化遗产作为"人类共同遗产"理念的先进性,以及作为特定社区或群体"私有制财产"理论的局限性。Since "Safeguarding of the Intangible Cultural Heritage" and "Protection of Folk Literary and Artistic Works" share the same term in Chinese-- "baohu", many scholars are so misled as to regard "safeguarding" and "protection" as identical. In fact, there are essential differences between the two both in terms of English expression and connotation. The former is a protection system de- veloped from the idea of "common heritage of humanity" created by UNESCO, while the latter is based on theory of "private property" created by WIPO. The great achievements in intangible cul- tural heritage protection have proved the advancement of this system based on the concept of "com- mon heritage of humanity", while protecting folk literary and artistic works in China is suffering great setbacks, which further proves that the theory of "private property" in certain communities or groups cannot avoid its limitations.
