摘　　要：自上世纪八十年代以来,尽管我国一直对毒品犯罪采取高压态势,但毒品犯罪数量、吸毒人数、查获毒品数量等却不降反升,毒品犯罪治理陷入了"越打越多"的困境。境外毒源地对中国渗透加剧,毒品犯罪组织的反打击能力增强,这些客观因素增加了毒品犯罪控制的难度。从刑事治理来看,存在毒品犯罪大量适用重刑、刑罚裁量过分重视涉案毒品数量、从严惩治的目标群体定位不准等问题。要有效地遏制毒品犯罪上升的趋势,需要对源头犯罪、对毒品犯罪组织中的核心成员从严,对受雇佣、受指使参加毒品犯罪的人从宽,弱化涉案毒品数量的刑法意义。Since 1980 sof the last century,the number of drug offenses,the number of drug users and the number of drugs seized have been rising although China has been taking high pressure on drug crimes.Obviously,drug crime has fallen into themore and more＂dilemma.The factors,such as increased penetration of toxic sources to China,increased anti-combat capability of drug-related criminal organizations and no direct harm to drug offenses,increase the difficulty of drug control.There are many problems concerning the drug crime control.For example,a large number of heavy penalties have been sued to drug crimes,and the number of drugs involved is too much.To effectively curb the rising trend of drug crimes,we have to take a severe criminal policy to the source of crimes and the core members of the drug criminal organization,and adopt a loose criminal policy to the employment by drug criminal organizations.In so doing,we can reduce the number of drugs involved in the criminal significance.
