社会治理背景下竞技体育有限自治的研究

摘　　要：在社会治理背景下,由于我国竞技体育发展的特殊历史背景,我国竞技体育行业自治应走一条从"有限自治"到"高度自治"的发展路线。通过确立"行业自治、政府引导、部门配合、公众参与"的多元管理模式,建立竞技体育行业有限自治体系,最终实现竞技体育行业高度自治。竞技体育有限自治体系要坚持司法最终解决的原则,并明确有限自治体系下竞技体育纠纷的救济范围和救济路径。Under the background of social governance,due to the special historical background of the development of competitive sports in China,the autonomy of the competitive sports industry should follow a development path from "limited autonomy" to "high autonomy".Through the establishment of the multi management model of "industry autonomy,government guidance,departmental coordination,public participation",the competitive sports industry limited autonomy system is established so that a high degree of autonomy will finally be achieved in the competitive sports industry.The limited autonomy system of competitive sports should adhere to the principle of judicial final settlement,and clarify the relief scope and relief path of the competitive sports disputes under the limited autonomy system.
