公、私立大学界分命题的现实挑战与重新诠释

摘　　要：随着国家、高等教育与市场之间法理关系的不断调适,公立大学"私营化"与私立大学公共性的凸显成为趋势,公、私立大学界分的经典命题受到挑战。当然,公、私立大学在"大学哲学内涵"包括任务范畴与"事物本质"上的区别,使两大法律体系依旧恪守着公、私立大学在法律规制上的界分。在大陆法系,私法因素作为一种"治理工具"的引入具有相对性,公法依旧是其法律关系调整的主要渊源。在英美法系,公、私立大学在法律规制上的区别日益"精细化"。两大法律体系的私立大学都倾向于适用非营利性法律、契约法或私法的规制。经典命题的重新诠释,有力地回应了公、私立大学之间界限模糊,公私莫辨等所谓的新兴命题对公、私立大学界分传统的质疑。With the continuous adjustment of legal relationship among the state, higher education and market, the prominence from the privatization of public universities and the publicity of private universities has become the tendency. Therefore, the classical proposition of distinguishing public and private universities is faced with challenge. With no doubt, the distinction between public and private universities in the “university philosophical connotation”, including the mission category and “essence of things”, between two major legal system is still observed. As for continental legal system, the introduction of private law factors as a kind of “governance tool” has its relativity. And the public law is still the main source of adjustment of its legal relations. As for Anglo-American legal system, the distinctions between public and private universities in the legal regulation is increasingly “refined”. The private universities in two major legal systems tend to be applicable to the non-profit law and the regulation of contract law or the private law. The reinterpretation of classical proposition strongly respond the query that the vague demarcation between public and private universities exists and the fact that the newly-developing proposition like the confusion between public and private universities as well as the traditional demarcation of public-private universities.
