摘　　要：引入社会主体和资源,运用经济工具保护土地能够提高效率、降低成本并维护土地所有者利益;域外市场主导的土地信托保护发端于政府主导土地保护的困境,其核心环节包括"职能外包-建立信托-企业化运营和专业分工-经济补偿和平等协商-监管和精细化经营"五部分;通过专业分工和市场化运作,提高土地保护绩效,减少权利寻租,创造丰富的公共休憩空间;但也存在欠缺约束力、绿票讹诈和持续性、均衡性问题。选择借鉴其思维,推动中国土地保护社会化有助于降低管理成本、扩充社会资源、平衡土地利益,同时已具备政策、经济、社会基础条件。应借助土地流转和生态补偿政策改革顶层设计,培育社会土地保护主体和相关机构,拓宽筹资渠道,建立"政府引导+市场运作"的体制,实现土地保护的共管共治,直至善治。The introduction of social land conservation agencies and resources,and use of economic tools have significant effects on promoting efficiency,reducing costs and protecting land owners＇ interests. Land trust conservation is an innovation led by the dilemma of government-oriented land conservation,which includes 5 key steps government functional stripping,establishing trust,enterprise operation and professional division of labor,economic compensation and equal consultation,supervision and meticulous management. It can improve the land conservation performance,reduce rent-seeking risk,and create high quality public leisure space,but also has problems such as lack of binding,greenmail and persistent,and equilibrium. It is helpful to reduce the management cost,expand the social resources and balance the social land interests,and already has the basic policy,economy and society establishment condition. It should use land transfer and ecological compensation policy to reform the top-level design,support land conservation third-parties and relevant social institutions,broaden the financing channels. Finally we could establish a ＂ government guided and market operated＂ system,to achieve good governance of land conservation.
