摘　　要：从英国脱欧公投的宪法学分析入手,对英国议会主权理论进行批判性分析。英国宪法中政治主权与法律主权的划分存在着结构性张力,通过引入宪法政治与审议民主[1]理论,有助于化解政治主权与法律主权之间所存在的这种张力,并借助审议民主理论去完善全民公投制度。审议民主是一种高阶民主,政治与法律理论应当从宪法政治的角度去理解审议民主。Discussion begin with United Kingdom European Union membership referendum,the author analyzes the inherent contradiction between legal sovereignty and political sovereignty in English constitutional theory. One path to solve the contradiction is to introduce the theory of constitutional politics and deliberative democracy, so as to reform the institution details of referendum.Additionally,author emphasizes that deliberative democracy is kind of higher order democracy,political and legal theory should take deliberative democracy as a higher order democracy in perspective of dualist democracy.
