摘　　要：我国的排污许可制度经历了产生、发展与形成三个阶段,现已基本建立起排污许可制度的总体框架,下一步的发展方向将是为排污许可设计具体的实施制度。现有法律规定为排污许可提供了基本的法律依据,但现有法律规定较为原则,缺乏可操作性。而作为实施排污许可具体依据的部门规章和规范性文件效力较低,无法为排污许可制度的实施提供有效的保障。我国应尽快制定排污许可管理条例,以形成由法律、行政法规、部门规章为一体的排污许可法律体系,为排污许可实践提供依据和指引。China＇ s pollutant discharge permit system has experienced three stages of emergence, development and formation. The general framework of the pollutant discharge permit system has been basically established. The next development direction will be to design a specific implementation system for the pollutant discharge permit system. The existing legal provisions provide the essential legal basis for the pollutant discharge permit system, hut not specific enough. The State Council should formulate management regulations for the pollutant discharge permit as soon as possible so as to form a legal system of pollutant discharge permit that is composed of laws, administrative regulations and departmental rules, and provide the legal basis and guidelines for the implementation of pollutant discharge permit.
