摘　　要：我国民法典关于权利失效的立法应当尊重现行实定法业已形成的法律传统。法律条款是否为权利失效规则,可遵循时间、状况和信赖的标准进行正向判断,并以法律效果标准进行反向排除检验。现行实定法中,我国《物权法》第202条、我国《合同法》第157条和第158条、我国《担保法》第25条和第26条在解释上应归入权利失效规则。未来我国民法典权利失效的规定应以分则特别条款规定权利失效的典型情形,以诚实信用原则调整例外情形,在保留实定法相关条款的基础上,增设合同解除权和返还原物请求权权利失效的特别条款。The legal traditions formed by the present Chinese civil laws should be respected at the time of enacting the Civil Code on invalidating right. Whether an article is a rule invalidating right may be determined to have a positive judgment according to standards of time,conditions and trust and tested to have a negative judgment according to the standard of legal effect. In the present Chinese civil laws,Article 202 of the Property Law,Article 157 and Article 158 of the Contract Law,and Article 25 and Article 26 of the Guarantee Law shall be categorized into rules invalidating right through interpretation. In the future legislation on invalidating right in the Civil Code,typical circumstances invalidating right shall be prescribed in the Special Provisions through special clauses,exceptional situations shall be determined according to the principle of good faith,special clauses of invalidating rights to rescind a contract and to claim the return the original property shall be added on basis of retaining relevant articles of the present laws.
